1. Scope

These General Terms and Conditions apply to contracts that consumers enter into with us through our online shop.

A consumer is any natural person who enters into a legal transaction for purposes that can be attributed predominantly neither to their commercial nor to their self-employed professional activity.

3. Offer and conclusion of the contract

The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to place an order.

You can add products to the shopping basket, review your entries during the ordering process and correct them before submitting the order. By clicking the button that submits an order with an obligation to pay, you make a binding offer to purchase the goods in the shopping basket.

Immediately after submitting the order, you will receive an order confirmation by email. We accept your offer when you receive this order confirmation; the purchase contract is thereby concluded.

The contract language is German. You can save or print the order details and these Terms and Conditions before submitting your order. You will also receive the essential order details by email.

4. Protection of minors

We supply alcoholic beverages exclusively to persons who have reached the minimum legal age applicable to the goods ordered. By submitting your order, you confirm that you meet this minimum-age requirement. We reserve the right to verify your age and to refuse or cancel an order if the required minimum age cannot be demonstrated.

5. Products, prices and deposits

The product prices displayed in the shop at the time of the order apply. All prices are stated in euros and include statutory VAT unless expressly stated otherwise.

For packaging subject to a deposit, the applicable deposit is shown separately in the product offer, shopping basket or checkout. The deposit is not part of the shipping costs.

Shipping costs may be charged in addition to the product price. The total amount applicable to your order, including shipping costs and deposits, is shown before you submit the order with an obligation to pay.

6. Payment methods and due date

Depending on the delivery country, device, shopping basket and availability, we offer the following payment methods:

• PayPal,
• PayPal Pay Later, where offered by PayPal and where the customer is eligible,
• credit and debit card,
• Google Pay on compatible devices,
• advance payment by bank transfer.

The payment methods actually displayed at checkout are definitive. For electronic payments, the amount is due immediately upon completion of the order. The terms of the selected payment service provider also apply.

If you pay in advance, you will receive our bank details with the order confirmation. Please state the order number as the payment reference. Processing and shipping take place once full payment has been received.

7. Delivery area, shipping costs and delivery time

Germany: We ship with DHL. Standard shipping costs €6.90 including VAT. Shipping within Germany is free for orders worth €99.00 or more. The estimated delivery time is 3 to 5 working days unless otherwise stated for the product or at checkout.

International deliveries: We ship with GLS to the European destination countries enabled at checkout. Shipping costs depend on the destination country and order value and are displayed before the order is placed. Free shipping is not available for international deliveries. The estimated delivery time is 5 to 7 working days unless otherwise stated.

For advance payments, delivery periods begin on the working day after payment is received; for other payment methods, they begin on the working day after the contract is concluded. Deliveries are not made on Sundays or public holidays. We will notify you of any foreseeable delay as soon as it becomes known to us.

8. Damage in transit

If goods are delivered with obvious damage in transit, please report the damage to the delivery agent as soon as possible and inform us. Failure to make such a report does not affect your statutory rights, but it helps us assert our own claims against the shipping provider.

9. Retention of title

The goods remain our property until payment has been made in full.

10. Right-of-withdrawal information

The withdrawal period is fourteen days from the day on which you, or a third party named by you who is not the carrier, takes possession of the goods. For an order consisting of several goods delivered separately, the period begins upon receipt of the final item.

by means of an unequivocal statement, for example by email or letter, of your decision to withdraw from this contract. You may use the model withdrawal form below, but its use is not mandatory. You may also use the “Withdraw from contract” function provided on our website.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the withdrawal period expires.

Effects of withdrawal

If you withdraw from this contract, we will reimburse all payments received from you, including the cost of the least expensive standard delivery offered by us. Additional costs resulting from your choice of a different type of delivery will not be reimbursed.

We will make the reimbursement without undue delay and no later than fourteen days after the day on which we receive your notice of withdrawal. We will use the same means of payment that you used for the original transaction unless expressly agreed otherwise. You will not incur any fees as a result of the reimbursement.

We may withhold reimbursement until we have received the goods or until you have supplied evidence of having returned the goods, whichever occurs first.

You must return or hand over the goods to us without undue delay and no later than fourteen days after the day on which you inform us of the withdrawal. The deadline is met if you send the goods before the fourteen-day period expires. You bear the direct cost of returning the goods.

You are liable for any diminished value of the goods only where it results from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

Exclusion or early expiry of the right of withdrawal

The right of withdrawal does not apply, or expires early, in the cases provided for by law. These include, in particular, goods liable to deteriorate or expire rapidly, goods made to the customer's specifications, and sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.

11. Statutory rights in the event of defects

The statutory rights in the event of defects apply. If goods are damaged, defective or incorrectly delivered, please contact [email protected] and state your order number.

12. Liability

We accept unlimited liability for intent and gross negligence, for culpable injury to life, limb or health, for guarantees we have given and under mandatory statutory provisions, in particular the German Product Liability Act.

In the event of a slightly negligent breach of an essential contractual obligation, our liability is limited to the type of damage that is typical of the contract and foreseeable when the contract is concluded. Essential contractual obligations are obligations whose fulfilment is necessary for the proper performance of the contract and on whose fulfilment the contracting parties may regularly rely. Liability for slight negligence is otherwise excluded.

14. Consumer dispute resolution

Copacking GmbH is neither obliged nor willing to participate in dispute-resolution proceedings before a consumer arbitration board.

15. Governing law

The law of the Federal Republic of Germany applies, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. In relation to consumers, this choice of law applies only insofar as it does not deprive the consumer of the protection afforded by mandatory provisions of the country in which the consumer has their habitual residence.
